1. Acceptance of Terms

By creating an account or accessing any part of the Fusion platform, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and accept these Terms & Conditions in full. If you are using Fusion on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. Description of Services

The Fusion platform provides the following core services:

• Data Diagnostic Tool (DDT): An AI-powered research and intelligence assistant for the hydrogen industry. DDT processes your queries against curated hydrogen industry documents using large language models and semantic search to generate analytical responses.
• Hydrogen Marketplace: A directory for discovering and connecting with suppliers of hydrogen equipment, components, and materials. Fusion does not directly facilitate transactions — it connects buyers and sellers.
• Fusion Networking Hub: A professional social network for hydrogen industry stakeholders, enabling connections (Bonds), posts (Pulses), direct messaging (Cells), and organisation pages.

We reserve the right to modify, suspend, or discontinue any feature or the entire platform at any time with or without notice.

3. User Accounts

• You must register for an account to access platform features. You are responsible for maintaining the confidentiality of your credentials.
• You agree to provide accurate, current, and complete information during registration and keep your profile up to date.
• You are solely responsible for all activity that occurs under your account.
• You must notify us immediately at support@hydrogenhub.tech if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the platform.

4. Acceptable Use

You agree not to use the Fusion platform to:

• Post content that is false, misleading, defamatory, abusive, threatening, obscene, or illegal
• Impersonate any person, company, or entity
• Scrape, harvest, or extract data from the platform by automated means without our written consent
• Attempt to gain unauthorised access to any part of the platform, its servers, or databases
• Upload or transmit viruses, malware, or any other harmful code
• Use DDT to generate content intended to deceive, manipulate markets, or misrepresent scientific data
• Spam other users via the messaging or networking features
• Violate any applicable local, national, or international law or regulation

Violations may result in immediate account suspension and, where appropriate, referral to law enforcement authorities.

5. DDT — AI-Generated Content Disclaimer

The Data Diagnostic Tool generates responses using artificial intelligence based on curated hydrogen industry documents and market data. You acknowledge and agree that:

• DDT responses are provided for informational and research purposes only and do not constitute professional, financial, legal, or technical advice.
• AI-generated content may contain inaccuracies, omissions, or errors. You should independently verify any information before making business or investment decisions based on DDT outputs.
• Dynamic Bio LLC is not liable for any decisions made or actions taken in reliance on DDT-generated content.
• DDT query limits may apply based on your subscription tier.

6. Marketplace Listings

The Hydrogen Marketplace is a listing directory. Dynamic Bio LLC does not participate in, warrant, or take responsibility for any transaction, contract, or agreement made between buyers and sellers through the platform. Specifically:

• We do not verify the accuracy of product listings, pricing, or availability.
• We do not act as a broker, agent, or intermediary in any commercial transaction.
• Sellers are solely responsible for the accuracy of their listings and fulfilment of any agreements made with buyers.
• We reserve the right to remove any listing that violates these terms or that we deem inappropriate at our sole discretion.

7. Intellectual Property

All content on the Fusion platform — including but not limited to the DDT interface, marketplace design, networking features, logos, graphics, and software — is the property of Dynamic Bio LLC and is protected by applicable intellectual property laws.

You retain ownership of content you create and post on the platform (posts, profile content, marketplace listings). By posting content, you grant Dynamic Bio LLC a non-exclusive, royalty-free, worldwide licence to display, distribute, and use that content solely for the purpose of operating and improving the Fusion platform.

You may not reproduce, distribute, modify, or create derivative works from any Fusion platform content without our express written permission.

8. Privacy

Your use of the Fusion platform is also governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference. Please review it to understand how we collect, use, and protect your personal data.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Dynamic Bio LLC, its directors, employees, partners, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from reliance on AI-generated DDT content
• Any transaction or dispute between marketplace buyers and sellers
• Interruptions, errors, or unavailability of the platform

Our total aggregate liability to you for any claims arising from these terms or use of the platform shall not exceed the amount you paid us in the three months preceding the claim, or USD $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dynamic Bio LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the platform, your content, your violation of these terms, or your violation of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Pasco County, Florida.

12. Changes to These Terms

We may update these Terms & Conditions at any time. Material changes will be indicated by an updated "Last updated" date at the top of this page. Your continued use of the platform after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
